The use of all asbestos containing materials was not banned until 1999. This means any building built or refurbished before the year 2000 could contain asbestos. The Control of Asbestos Regulations 2012, specifically Regulation 4, requires an employer to identify and manage asbestos in the workplace.

The ‘Duty to Manage Asbestos in Non-Domestic Premises’ is the responsibility of the person with overall accountability for the maintenance and upkeep of any non-domestic premises.

CAR 2012 Regulation 4 (3) states; ‘In order to manage the risk from asbestos in non-domestic premises, the dutyholder must ensure that a suitable and sufficient assessment is carried out as to whether asbestos is or is liable to be present in the premises.’
