Introduction
In terms of the Occupational Health and Safety Act and Regulations of 85 of 1993 as amended, the Law compels Employers to “protect” the health and safety of the Employee by various means.
Firstly, conducting a “Risk Assessment” based on what is seen or believed as being “reasonably practical” by a “Competent Person” of the proposed task to be undertaken by the Employee.
Secondly, by providing training and any safety equipment that may be required by the Employee before attempting to carry out that task.
